2017/2018 FOCUS ON EXCELLENCE CONTEST
OFFICIAL RULES


NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. PROMOTION DATES

a.            These rules (the “Official Rules”) govern the 2017/2018 Focus on Excellence Promotion (“Promotion”) will begin on Monday, September 11th, 2017 at 12:00:01 a.m. CT and end on Tuesday, June 8th, 2018 at 5:00:00 p.m. CT.

2.            ELIGIBILITY RESTRICTIONS

a.            The Promotion is open to all legal U.S. residents who are a Junior or Senior in high school, public or private (home school is ineligible),  and at least 14 years old at the time of entry, and who live in the Tulsa Designated Market Area, which includes the following Oklahoma counties: Osage, Washington, Nowata, Craig, Pawnee, Tulsa, Rogers, Mayes, Delaware, Creek, Wagoner, Cherokee, Adair, Okfuskee, Okmulgee, McIntosh, Muskogee, Haskell, Pittsburg and Latimer, and the following Kansas Counties: Chautauqua and Montgomery (the “Promotion Area”).   Employees of Scripps Media, Inc., d/b/a KHTT, KVOO, KBEZ, KXBL, & KFAQ (the “Promoter” or “Station”), its corporate parent, subsidiary, and affiliated entities, its advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the Tulsa metropolitan area, and the members of their immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win.  Void outside the Promotion Area and where prohibited. 

b.            Only one winner per household per 30 days is permitted in any Promoter contest.

c.             Winner, or winner’s parent or legal guardian if winner is not at least 18-years-of-age,  must hold a valid government-issued driver’s license and also must qualify for required automobile insurance, and present evidence of such insurance prior to the delivery of the prize.

d.            To be eligible to receive a prize, winner must have been enrolled in high school for the entire 2017/2018 school year.

e.            Entrants are required to provide truthful information and Promoter will reject and delete any entry that it discovers to be false or fraudulent.  Promoter will disqualify any entry from individuals who do not meet the eligibility requirements, and Promoter will also delete any online entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act and as otherwise required by law.

3.            ENTRY

a.            To participate in the Promotion, you may enter via the following methods:

                VIA ON SITE – To enter, visit Scripps Radio, Tulsa Operation, 4590 E. 29th St., Tulsa, OK, 74114, Monday through Friday, 8 a.m. CT to 5 p.m. CT, except on holidays.  You must fill out an entry form (while supplies last), submitting your first name and last name, complete address, city, county, state, zip code, high school, telephone number, date of birth, and a valid email address. You must also answer the following questions:

•             Are you a Junior or Senior in high school, and live in one of the following Oklahoma counties: Osage, Washington, Nowata, Craig, Pawnee, Tulsa, Rogers, Mayes, Delaware, Creek, Wagoner, Cherokee, Adair, Okfuskee, Okmulgee, McIntosh, Muskogee, Haskell, Pittsburg or Latimer, or one of the following Kansas counties: Chautauqua or Montgomery.

•             For which Grading Period are you submitting your entry?  “Grading Period” is defined as a quarter, trimester, or semester, depending on your school’s grade reporting practices.

•             Were you enrolled in at least five classes during this Grading Period? (to enter, the answer must be “yes”)

•             Did you receive all A’s and B’s for this Grading Period? (to qualify for one entry, the answer must be “yes”)

•             Did you receive perfect attendance for this Grading Period? (to qualify for an additional entry, the answer must be “yes”)

•             Have you been enrolled in high school the entire Grading Period? (to enter, the answer must be “yes”)

•             Will you, or a parent or legal guardian if you will not be at least 18-years-of-age on date of the end of the Promotion (6/26/18), have a valid driver’s license and qualify for required automobile insurance? (to win, the answer must be “yes”)

Entry form can be obtained ahead of time at www.focustulsa.com. Entries must be submitted by 5:00:00 p.m. CT on Friday, June 8, 2018. 

VIA POSTAL MAIL – To enter, mail an entry form (available at the Station or online at www.focustulsa.com) to Focus on Excellence, Scripps Radio, Tulsa Operation, 4590 E. 29th St., Tulsa, OK, 74114 Entrants must fill out an entry form, submitting your first name and last name, complete address, city, county, state, zip code, high school, telephone number, date of birth, and a valid email address.  You must also answer the following questions:

•             Are you a Junior or Senior in high school, and live in one of the following Oklahoma counties: Osage, Washington, Nowata, Craig, Pawnee, Tulsa, Rogers, Mayes, Delaware, Creek, Wagoner, Cherokee, Adair, Okfuskee, Okmulgee, McIntosh, Muskogee, Haskell, Pittsburg or Latimer, or one of the following Kansas counties: Chautauqua or Montgomery?

•             For which Grading Period are you submitting your entry? 

•             Were you enrolled in at least five classes during this Grading Period? (to enter, the answer must be “yes”)

•             Did you receive all A’s and B’s for this Grading Period? (to qualify for one entry, the answer must be “yes”)

•             Did you receive perfect attendance for this Grading Period? (to qualify for an additional entry, the answer must be “yes”)

•             Have you been enrolled in high school the entire Grading Period? (to enter, the answer must be “yes”)

•             Will you, or a parent or legal guardian if you will not be at least 18-years-of-age on date of the end of the Promotion (6/26/16), have a valid driver’s license and qualify for required automobile insurance? (to win, the answer must be “yes”)

Entry form can be obtained at www.focustulsa.com.  Entries must be delivered by 5:00:00 pm CT on Friday, June 28, 2018. Each entry by mail must include all requested information, as described above.

VIA INTERNET – To enter, visit www.focustulsa.com and follow the links and instructions to fill out an entry form, submitting your first name and last name, complete address, city, county, state, zip code, high school, telephone number, date of birth, and a valid email address.  You must also answer the following questions:

•             Are you a Junior or Senior in high school, and live in one of the following Oklahoma counties: Osage, Washington, Nowata, Craig, Pawnee, Tulsa, Rogers, Mayes, Delaware, Creek, Wagoner, Cherokee, Adair, Okfuskee, Okmulgee, McIntosh, Muskogee, Haskell, Pittsburg or Latimer, or one of the following Kansas counties: Chautauqua or Montgomery?

•             For which Grading Period are you submitting your entry?  “Grading Period” is defined as a quarter, trimester, or semester, depending on your school’s grade reporting practices.

•             Have you been enrolled in high school the entire Grading Period? (to enter, the answer must be “yes”)

•             Will you, or a parent or legal guardian if you will not be at least 18-years-of-age on date of drawing (6/26/18), have a valid driver’s license and qualify for required automobile insurance? (to win, the answer must be “yes”)

All entries must be submitted by 5:00:00 p.m. CT on Friday, June 8, 2018. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address.  Multiple entrants are not permitted to share the same email address.  Entries submitted will not be acknowledged or returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry will not be deemed proof of receipt by Promoter. The Promoter’s computer is the official time keeping device for the Promotion.   

b.            You may receive a maximum of four entries in the Promotion, which can consist of a maximum of two entries for official report cards containing all A’s and B’s,  and two perfect attendance records for the 2017/2018 school year during the dates of this Promotion. All decisions of Promoter management with respect to the Promotion are final.

4.            FINALIST SELECTION, VERIFICATION, AND NOTIFICATION

a.            Promoter will choose three finalists (the “Finalists”) by random drawing from among all eligible entries. Odds of being chosen as a Finalist depend upon the number of entries received.

b.            Promoter will attempt to notify each Finalist via email or telephone call. Potential Finalist must respond within 48 hours of initial notification attempt.

c.             Each potential Finalist (and his or her parent or legal guardian if Finalist is under the age of majority) may be required to execute and return an affidavit of eligibility and liability/publicity release within 48 hours of the time Promoter sends documents to Finalist.  Each potential Finalist (and his or her parent or legal guardian if Finalist is under the age of majority) may also be required to sign and return tax documents to Promoter. Potential Finalist may also be required to provide identification and to verify grades or attendance by providing school records to Promoter. If so, potential Finalist must do so before the Event (defined below).

d.            If a potential Finalist (and his or her parent or legal guardian where applicable) does not respond within 48 hours of initial notification attempt, is unwilling or unable to participate in the Event, fails to complete, sign and return the affidavit of eligibility and liability/publicity release or provide tax documents or provide identification within the required time period, fails to verify grades or attendance, or is not in compliance with the Official Rules,  potential Finalist will be disqualified and Promoter may select another potential Finalist (time permitting) by random drawing from among remaining eligible entries.

 

5.            WINNER SELECTION

a.            After each Finalist’s qualifications have been verified, they will be invited to the final giveaway event at Bob Hurley Ford (745 W. 51st St. Tulsa, OK 74107) on or about Tuesday, June 26, 2018 at approximately 2:00 p.m. – exact date and time to be determined (the “Event”).  Each Finalist must check in at the Promoter’s table and fill out a registration slip. If the Finalist is under 18, the Finalist must be accompanied by his or her parent or legal guardian at the Event.

b.            At the start of the Event, a Station representative will select the names at random from a fish bowl, determining the order that each Finalist will select a key fob. The Finalists will then attempt to unlock the Grand Prize Ford Focus in the order their names were drawn from the fish bowl by attempting to use their key fobs to unlock the Grand Prize Ford Focus. The Finalist whose key fob unlocks the Grand Prize Ford Focus on the showroom floor will be deemed the Grand Prize winner. The remaining two Finalists will receive the runner up prizes.

c.             Odds of a Finalist winning the Grand Prize are one in three.

d.            Finalist must be present to win a prize.

e.            Each potential winner (and his or her parent or legal guardian if potential winner is under the age of majority) may be required to execute and return and affidavit of eligibility and liability/publicity release at the Event (if he or she has not done so already). Each potential Finalist (and his or her parent or legal guardian if Finalist is under the age of majority) may also be required to sign and return tax documents to Promoter (if he or she has not done so already). Potential winner may also be required to provide identification and to verify grades or attendance by providing school records to Promoter at the Event (if Finalist has not done so already).

f.             If a potential winner (and his or her parent or legal guardian where applicable) fails to complete, sign and return the affidavit of eligibility and liability/publicity release or provide identification within the required time period, fails to provide required tax documents, fails to verify grades or attendance, or is not in compliance with the Official Rules, potential winner will be disqualified. If the disqualified winner was the potential Grand Prize winner, Promoter may select another potential Grand Prize winner (time permitting) by allowing the runner up prize winners to do the key fob exercise again.

g.            The runner up prizes will be awarded at the Event. The Grand Prize must be picked up at Bob Hurley Ford, 745 W 51st St, Tulsa, OK 74107, as arranged by Bob Hurley Ford.  The winner will forfeit any prize not claimed within 30 days of notification of winning.

6.            PRIZES

a.            One Grand Prize winner will be awarded a 2018 Ford Focus, base model or better.  The approximate retail value of the Grand Prize is $20,000.00.  Grand Prize winner, or Grand Prize winner’s parent or legal guardian if Grand Prize winner is not at least 18 years of age, will be solely responsible for any applicable vehicle title, license and registration fees, freight, delivery, dealer prep, emissions inspection, additional equipment, all federal, state and local taxes, insurance, gasoline, vehicle maintenance, all other fees and expenses not specified herein associated with the receipt and use of the Prize.  At the time of the drawing, if the winner is not at least 18 years-of-age, the car must be titled in the winning student’s parent’s or legal guardian’s name and will be awarded to the parent or legal guardian on behalf of the winner.  Any additional options (including the interior and exterior color) not specified herein are subject to availability and will be the responsibility of the winner.  Prize winner, or prize winner’s parent or legal guardian if the winner is not at least 18 years-of-age, must provide proof of insurance and a valid driver’s license to take delivery and must take delivery at a dealership designated by Promoter within 30 days following date of notification of winning.  Except as provided above, prize is not transferable. The prize vehicle is provided as is. 

                Two $1,000 gift cards from Okalahoma Wesleyan University, will be awarded to the two runner-up winners, in addition to Pizza for a Year – consisting of one large one topping pizza a month for 12 months from Papa John’s Pizza.

b.            All prizes are awarded as-is.  There is no substitution, transfer, or cash equivalent for prizes, except that Promoter may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the items listed above and do not include taxes, gratuities or any other expenses.  Promoter is not responsible for winners’ limitations that prevent acceptance, use, or nonuse of prize.  Entrants acknowledge that the Released Parties, as defined herein, have not made, nor are in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties expressed or implied, in fact or in law, whether now or hereafter enacted concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition, or fitness for a particular purpose, except for any express manufacturer’s warranty as may be included with the prize or as may be separately provided to participants by law. 

c.             Any gift cards are subject to the terms and conditions as set forth by the issuer of the gift cards.  Such gift cards are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will such gift cards be replaced if unused, lost, stolen, or damaged. 

7.            CONDITIONS

a.            Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by Promoter in a calendar year with an aggregate value of $600 or more.

b.            Participating in the Promotion and acceptance of any prize constitutes each entrant’s and winner’s permission for the Promoter or its agents to photograph, film, record that entrant and winner and to use his or her name, city, state, voice, or likeness, and any statements made by him or her regarding the Promotion or its Sponsors (defined below) for purposes of trade in connection with the Promotion, publicity or promotion without additional financial or other compensation, and to sign a publicity release confirming such consent prior to acceptance of the prize.

c.             Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Promoter in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification.  By entering, participating and/or accepting a prize in the Promotion, each entrant and winner agrees not to sue and to release, discharge, indemnify,  hold harmless, and absolve the Promoter, the Sponsors, and the advertising and promotion agencies and any other entity involved in the development or administration of the Promotion and each of their respective parent, subsidiary and affiliated entities and the officers, shareholders, directors, employees, agents, and representatives and the successors and assigns of each of them (the “Released Parties”) from and against any and all claims, demands, actions, suits, losses, expenses, costs, damages, and liabilities including, without limitation, interest, penalties, court costs and reasonable attorneys’ fees and expenses arising directly or indirectly from the prize or participation in the Promotion, including, but not limited to, personal injury, death, or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and merchandise delivery.  Except where prohibited, by entering the Promotion, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes must be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Hamilton County, OH; (2) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, but in no event will such costs include attorneys’ fees; and (3) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded. This Promotion will be governed and enforced pursuant to Ohio law, excluding choice of law provisions.

d.            Promoter, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if Promoter discovers that he or she has tampered with the entry process, the operation of the Promotion, or the operation of Promoter’s web site or is otherwise in violation of the Official Rules or direction of Promoter.  Promoter further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Internet portion of the Promotion if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Promoter’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by Promoter in is sole discretion.  If Promoter does so, Promoter will announce its decision on the Promotion website and will choose Finalists by random drawing from among all eligible, non-suspect Internet entries received as of the termination of the Internet portion of the Promotion and all eligible on site and mail-in entries received by the deadlines set forth above. Promoter’s failure to enforce any term of these Official Rules will not constitute a waiver of this provision.  If due to circumstances beyond the control of Promoter, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Promoter reserves the right, but not the obligation, to modify, suspend, or cancel the Promotion and will not be required to award a substitute prize.

e.            The Released Parties are not responsible for (1) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (2) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or any other difficulties that may prevent an individual from entering or participating, or (3) lost, stolen, mangled, misdelivered, misdirected, postage due, illegible, incomplete, incorrect, or late entries.  Further, the Released Parties are not responsible if any part of a prize that cannot be awarded due to acts of God, acts of war, natural disaster, weather, acts of terrorism or other factors beyond the Station’s control.

f.             To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to 2017/2018 Focus on Excellence Winner List or Official Rules Request, Scripps Radio, Tulsa Operation, 4590 E. 29th St., Tulsa, OK  74114.  A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at Scripps Radio, Tulsa Operation, 4590 E. 29th St., Tulsa, OK  74114.  All such requests must be received within 60 days following completion of the Promotion.
